Musk says any winnings from suing OpenAI will go to charity; $109 billion claim to go to trial in April
Elon Musk posted on X that if he wins the lawsuit against OpenAI, all proceeds will be donated to charity and he will not profit from it.
The lawsuit was filed by Musk in 2024, accusing OpenAI CEO Sam Altman and partner Microsoft of abandoning OpenAI's original non-profit mission and shifting to a for-profit structure. Musk is a co-founder of OpenAI, having invested about $38 million in its establishment in 2015 and left in 2018 to start his AI company xAI.
The presiding judge has allowed the damage report from Musk's expert witness, which estimates OpenAI could owe up to $109 billion in compensation. The case is scheduled for jury trial on April 28, and both OpenAI and Microsoft deny all charges.
